It doesn’t matter whether Biden knew it or not. What matters is that Trump knowingly removed Top Secret documents from the White House, failed to turn them over to NARA, and they were finally seized by the FBI last Monday.
Willful retention, and refusal to turn over Top Secret documents are a violation of Section 793 of the Espionage Act of 1917, punishable by up to 10 years in Federal prison.
By the way, it also doesn’t matter whether Trump declassified any documents. Top Secret documents CANNOT be declassified.
